Please read these Terms of Service ("Terms") carefully before using Shoutswap or any of our associated applications, including Purepick (collectively, the "Services"), operated by Shoutswap ("we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By creating an account or accessing the Services, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy.

2. Description of Services

Shoutswap is a social media amplification platform that helps brands and creators grow their reach through coordinated authentic human engagement. Our App Factory, which includes Purepick, develops additional mobile applications to solve real-world problems.

3. User Accounts

  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information during registration.
  • You are responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any regulations
  • Engage in spam, phishing, or deceptive practices
  • Attempt to gain unauthorized access to any part of the Services
  • Reverse-engineer, decompile, or disassemble any part of the Services
  • Violate any third-party platform's terms of service while using our Services
  • Upload malicious code or interfere with service integrity

5. Intellectual Property

All content, trademarks, logos, and intellectual property on the Services are owned by Shoutswap or its licensors. You may not use them without prior written consent. You retain ownership of content you submit but grant Shoutswap a worldwide, non-exclusive license to use, display, and distribute it for operating the Services.

6. Payment Terms

  • Fees are billed in advance on a monthly or annual basis.
  • All fees are non-refundable except as described in our Refund Policy.
  • We reserve the right to change pricing with 30 days' notice.
  • Failure to pay may result in suspension or termination of your account.

7. Termination

We reserve the right to suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our sole discretion. You may cancel your account at any time through the account settings.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. See our full Disclaimer.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOUTSWAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify and hold harmless Shoutswap and its officers, directors, employees, and agents from any claims arising out of your use of the Services or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Shoutswap is incorporated, without regard to conflict of law principles.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the new Terms.
